Provisional Acceptance During the provisional acceptance stage, an inspection report is drawn up to record any visible defects identified by the purchaser. From that point onwards, you have a minimum period of one year to occupy the property and report any issues that may become apparent during normal use, such as faulty heating in a bedroom or a leaking tap.

Final Acceptance Final acceptance takes place at least one year after provisional acceptance. After this period, the ten-year structural warranty remains applicable, but only for serious defects affecting the property, particularly those relating to the building’s stability, waterproofing or structural integrity.

As the development is sold under the Breyne Act, payments are made in stages according to the progress of the construction works. A deposit limited to 5% is payable upon signing, followed by instalments linked to each construction phase. The remaining balance is paid at provisional acceptance. No payment may exceed the value of the works already completed.

Pagode benefits from an advantageous tax structure:

• The first three floors are subject to registration duties (12.5%) rather than VAT, as they form part of the refurbishment of an existing building.
• Apartments on the fourth floor are sold under a split land/construction scheme: the land is subject to 12.5% registration duties, while the construction element is subject to 21% VAT.

The advertised prices for Pagode exclude additional costs. Buyers should budget for:

The Breyne Act provides several protections for purchasers. These include a completion guarantee ensuring delivery of a finished property, as well as protection against hidden defects and the ten-year structural warranty, which also applies to the seller or developer. These guarantees must be clearly stated in the sales agreement. Proof of the guarantee coverage is provided when signing the notarial deed.

Yes. Depending on the progress of the construction works, buyers may still be able to choose the kitchen, sanitary fittings, floor and wall finishes, as well as interior doors.
